Terms of Service

These are draft terms currently in effect. A legally reviewed version will be published soon. By using CapeLoad, you agree to these terms.

1. Acceptance of Terms

By accessing or using the CapeLoad platform (website, mobile interface, or any related services), you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

2. Services

CapeLoad provides an online logistics marketplace that connects clients who need goods transported with independent owner-operator drivers. CapeLoad acts as an intermediary and is not itself a transport carrier.

Clients use the platform to request and pay for transport jobs.
Drivers (owner-operators) use the platform to receive and complete jobs.
CapeLoad facilitates matching, payment processing, and communication between both parties.

3. User Accounts

You must provide accurate and complete information when registering. You are responsible for maintaining the confidentiality of your password and for all activity under your account. Notify us immediately of any unauthorised access.

4. Driver Registration

Drivers must hold a valid South African driving licence and vehicle registration. All vehicles must be roadworthy and adequately insured. CapeLoad reserves the right to approve or reject any driver application at its discretion.

5. Bookings and Payment

Quotes generated on the platform are estimates based on distance and vehicle type. Final pricing may vary. Payment is due on completion of the job via the selected method (card, EFT, or Yoco). CapeLoad collects a commission on each completed booking.

6. Cancellations

Cancellations made more than 1 hour before the scheduled pickup time may be eligible for a full refund. Late cancellations or no-shows may incur a fee. Drivers who repeatedly cancel without notice may have their accounts suspended.

7. Liability

CapeLoad is not liable for loss, damage, or delay of goods in transit. Clients are encouraged to ensure goods are properly packaged. Drivers are responsible for the safe transport of goods once a job is accepted.

CapeLoad's total liability in any event shall not exceed the total amount paid for the specific booking in question.

8. Prohibited Use

Transport of illegal, hazardous, or prohibited goods.
Misrepresentation of goods, weight, or destination.
Harassment or threatening behaviour toward drivers or clients.
Circumventing the platform to conduct private transactions with matched parties.

9. Intellectual Property

All content, logos, and branding on the CapeLoad platform are the property of CapeLoad Logistics and may not be reproduced without written permission.

10. Changes to Terms

CapeLoad reserves the right to modify these terms at any time. Changes will be communicated via email or displayed on the platform. Continued use of the platform after changes constitutes acceptance.
